Terms ✦ Service
The following terms and conditions, as well as the listed prices, are meant for PERSONAL COMMISSIONS only. The prices and terms for commercial artworks differ from the ones stated on this page and can be discussed with the client privately. Before sending an inquiry, please read the following terms.If you have any questions regarding commission types, terms of service, or if you simply wish to see more examples of my artwork and get additional information, then please send an e-mail to rozelque@gmail.com or you can also contact me through this link.1. Scope of Work
1.1. The Artist agrees to create a custom artwork as described in the commission request and agreed upon by both parties.
1.2. Any changes to the scope of work must be agreed upon in writing by both parties and may result in additional charges.2. Payment
2.1. Payment is solely accepted via PayPal in USD.
2.2. The Client acknowledges and agrees that full payment is required upfront before the Artist commences work on the commissioned artwork, and an additional tax will be applied in the final price (+5% from the commission price).3. Delivery
3.1. The Artist will provide the Client with progress updates. There are mainly three (3) phases for the commission (sketch, rough color, and final render). However, please note that the amount of phases may differ depending on the commission type.
For Anime Render and Digital Painting commission types : Progress updates will be sent during the start of sketch, rough color, and final render stages.
For Cel Shading commission type : Progress updates will be sent during the start of rough sketch and final render stages.
The Client may also be invited to my private Trello page for a more effortless experience in update tracking.
3.2. The final artwork will be delivered to the Client upon completion, in high-resolution JPEG/PNG.
3.3. Any additional requests for files, such as the source file (PSD), will incur an additional charge.4. Copyright and Usage
4.1. The Artist retains the copyright to the commissioned artwork.
4.2. Both parties agree that the commissioned artwork will not be used for commercial purposes.
4.3. The Client is granted a non-exclusive, non-transferable license to use the artwork for personal purposes only, unless otherwise agreed in writing.
4.4. The Artist may publish the commissioned artwork for social media posts and portfolio in a lower resolution image than the one sent to the Client.
4.5. Both parties agree that any part of the commissioned artwork will not be used for non-fungible tokens (NFT). In addition, the use of the artwork for any advertising or profits associated with non-fungible tokens, blockchains, or cryptocurrency is strictly prohibited.5. Revisions
5.1. Both parties recognize that the term "Major Revision" means a revision that involves redrawing or repainting, covering a part or the entire drawing, while the term "Minor Revision" means a revision that involves adjustments that can be made without redrawing, such as color or tone adjustments and small changes.
5.2. Each commission type has its own revision limit, as described below:
For Anime Render and Digital Painting commission type : Major revisions (up to two) are possible during sketch phase. Additional major revisions will incur an extra fee. Subsequently, only minor revisions are allowed during the rough color and final render phases.
For Cel Shading commission type : Minor revisions are allowed during sketch and final render phases. However, major revisions will incur extra charges.
5.3. If important and/or key details have been missed by the Artist, this will be rectified without charge if the missing component is clearly seen on the reference. However, if the key details in question are not provided beforehand or not clearly seen on the reference(s) provided, this will incur a fee based on how long it takes to be rectified.6. Cancellations
6.1. Both the artist and the client may cancel the commission with written notice.
6.2. A full refund is available if the client decides to cancel the commission before the artist initiates work on the artwork.
6.3. If the artist has already commenced work, a 50% refund is the maximum amount eligible for cancellation. The remaining 50% compensates for the time and effort invested in the project.7. Confidentiality
7.1. If the Client requests the commissioned artwork to be confidential, there will be additional charges.
